Terms of Use for Open Data Portals and Datasets 

Description 

All data and datasets published by the Africa Development Bank Group (AfDB) on this Open Data Portal are provided under the Creative Commons Attribution 4.0 International License (CC-BY 4.0). The African Development Bank provides users with access to the Portal free of charge subject to the terms of this agreement, and subject to the general Terms and Conditions for using the African Development Bank website, which are incorporated into these Portal Terms. While this Portal is governed by the CC-BY 40 License, the general Terms and Conditions of the AfDB website are also applicable to this Portal. Where these Portal Terms conflict with the general Terms and Conditions, these Portal Terms shall prevail. Use of data derived from the datasets, which may appear in formats such as tables and charts, is also subject to these Terms.   

License Grant 

Users are encouraged to use the datasets on this site to benefit themselves and others in creative ways. Users are permitted to extract, download, and make copies of the data contained in the datasets, as well as share the data with third parties within the terms of use listed below. 

By using (as defined below) or downloading the datasets on the Africa Development Bank Group Websites, you are agreeing to comply with the Terms and Conditions of a CC-BY 4.0 License, as well as the terms specified in this License.​ The Bank hereby grants users a worldwide, royalty-free, non-sublicensable, non-exclusive, and irrevocable freedom to use the data and databases under the following terms:

Attribution 

Users must attribute any public use of the database, or works produced from the database, to the author and/or owner of the copyrighted material, which includes providing a link to the data source. However, this must be done in a reasonable manner that clearly indicates that the licensor (the AfDB) does not endorse any resulting works created from the data. 

Attribution must be formatted in the following manner: The African Development Bank: Dataset name: Dataset link. 

When sharing or facilitating access to the datasets, users must include the same acknowledgement requirement in any sub-licenses of the data that is granted, and a requirements that sub-licensees do the same.  

Notice 

- Keep copyright and license notices intact. For any use or redistribution of data or works produced from the database, users must make clear to others the license of the database and keep intact any copyrights and notices on the original database. You also may not apply legal terms or technological measures that legally restrict others from utilizing the data in a manner that this license permits. 

State Changes 

- Users must indicate in their works which changes have been made to the original licensed work in a manner that permits attribution. 

Additional Information 

No endorsement: Nothing in this Public License constitutes or may be construed as permission to assert or imply that you are, or that your use of the Licensed Material is connected with, or sponsored, endorsed or granted official status by the Licensor (the AfDB) or others designated to receive attribution. The AfDB reserves the right to prosecute, to the fullest extent of the law, any use of our datasets in a manner that falsifies, misrepresents, disparages or fraudulently uses the materials provided on these datasets. 

Privacy: The African Development Bank Group will not publish private or confidential information as open data or any other information that has implications on the public safety or national security. 

Data publishing: The data published on this platform is published in both human and machine-readable formats, with a preference for open standards to encourage wide reuse. The AfDB confirms that all data available on this platform are being maintained and updated at regular, periodic intervals. The AfDB also reserves the right at any time and when deemed necessary to modify or discontinue, temporarily or permanently, this website, the datasets, and any means of accessing or utilizing the datasets, at our sole discretion with or without prior notice to users. 

Exclusion of Liability: The African Development Bank Group shall not be responsible or liable to users for any loss or damage of any sort incurred in connection with the use of the datasets. The AfDB shall also not be responsible or liable for the accuracy, usefulness or availability of any data in the datasets.

These Datasets Terms incorporate the AfDB’s Terms and Conditions by reference. By using the Open Data Portals or any presentation of data derived from them, you consent to be bound to the African Development Bank’s Terms and Conditions, including these Dataset Terms. The African Development Bank may amend these terms at any time at our sole discretion.
